Former Company Director charged with giving False Statements to CCM
KUALA LUMPUR, Dec 16 (Bernama) -- A former managing director of a consulting company pleaded not guilty in the Sessions Court here today to five counts of making false statements to the Companies Commission of Malaysia (CCM).

On the first charge, Teoh Hun Siang, 38, is alleged to have made a false statement on the appointment of Eng Teh & Associates (Eng Teh) as an auditor of Outsourcing Consortium Sdn Bhd when he very well knew that the audit firm had never agreed to do so.

The offence was allegedly committed at the CCM, Second Floor, 10-18 Putra Place, 100 Jalan Putra here on Sept 16, 2006.

The offence, under Section 364(2) of the Companies Act, carries a jail term of up to 10 years or RM250,000 fine or both, if convicted.

On the second count, Teoh is charged with submitting a false audit report, purportedly prepared by Eng Teh, with an intention to mislead a director of a textile supplier, Manhara Fashion Sdn Bhd.

He was alleged to have committed the offence, under Section 364(1)(a) of the Companies Act, at 38-2, Jalan 25/70A, Desa Hartamas, between Dec 12, 2006 and Aug 17, 2007.

On the third, fourth and fifth charge, Teoh is alleged to have submitted false reports on the financial statements for the year ending June 30, 2005, June 30, 2006 and June 30, 2007, also purportedly prepared by Eng Teh, to a director of an export and import company, Xiang De Sdn Bhd.

The offences were allegedly committed at No. 3-2, Jalan Metro Perdana Timur 1, Taman Usahawan Kepong here, between Oct 18, 2007 and Feb 26, 2009.

Judge Zulhazmi Abdullah allowed Teoh bail of RM70,000 in one surety and set Jan 16 for mention. He also ordered Teoh to surrender his passport to the court.

Prosecution was conducted by prosecuting officer from CCM, Steve Chin Yun Cheong, while Teoh was unrepresented.
